    • It was recorded with the County Clerk on 5 January 1849.

      "In the name of God, Amen.

      "To those whom these present may come, Know ye that I Stephen Johnson of the County of Grainger and State Tennessee, being in my usual health and of sound mind and memory. Never the less calling to mind that it is appointed once for all men to die, do make, ordain, and constitute the following to be my last will and testament hereby revoking all others heretofore by me made.

      "First I give and commend my soul into the hands of God who gave it and my body to a decent Christian burial and after the expenses thereof are paid, and all my Just Debts are paid, the remaindr of my property, goods and chattles, which it has pleased God to ___ me, Shall be disposed of as follows.

      "To wit. I give and bequeath to my son James Johnson three negroes to wit. Sylvia and her children and a boy named Dave together with all my land and improvements thereon lying on the north side of holsten river being the same whereon I now live and being in consideration of the _____ of body of said Negro woman Sylvia. My will is that said James shall have one hundred dollars beside the abovethe whole of whereof is valued at two thousand dollars.

      "Secondly, I give and bequeath to my son Hardy Johnson all and Singular a certain piece or pieces tract or tracts of land lying on the south side of Holsten river being he place whereon said Hardy now lives together with two hundred dollars. The whole amount whereof to value at two thousand dollars.

      "Thirdly I give and bequeath to my Daughter Polly Stubblefield four negroes, to wit, John, Clara the younger, Mariah and Allen, and fifty dollars on account of the Death of a boy heretofore by me devised to said Polly. The above Negroes and the fifty dollars together with what I have already given her, Valued at two thousand dollars. Also at my Death my will is that my Daughter Polly shall take Clara (the Elder) at whatever two disinterested persons shall value her to be worth.

      "_________ at my death my Negro man Arthur shall [be] sold or valued. If sold the price thereof to be equally divided between my sons James and Hardy if valued and one son agree to take him at the valueuation. He so doing shall pay the other son one half the valuation money and should said Arthur not be valued or sold for double the sum that said Clara is valued at, in that case my two sons James & Hardy shall have a sufficient sum out of the proceeds of my other property, herein and hereafter directed to be sold to make each of my sons shares equal to the valuation of the aforesaid Clara. The rest of property goods and chattles not herein devised I wish and my is that my death shall be sold to highest bidder and the proceeds thereof after complying with all the foregoing requestions to be equally divided among my three children to wit. James Johnson, Hardy Johnson and Polly Stubblefield.

      "And furthermore be it Distinctly understood that my will is and it hereby expressly declared that all and singular my property ___ hereby devised and bequeathed to my Daughter Polly Stubblefield shall be and is to her and her Lawfull heirs forever provided never _____ that at any time hereafter should my execution ___ from the then existing circumstances that the property or any part thereof hereby devised to said Daughter and her children to pay and contracts created by her husband George Stubblefield or for any other cause the said property hereby devised shall be in danger of to be taken from her and her children in that case it shall be the duty of my Executors shall take said property into their possession and dispose of the same as in their Judgement shall best promote the interest benefit and support of said Daughter Polly Stubblefield and her children. Futhermore my will and desire is that not any of property hereby given to her the said Polly and her children shall ever applied to payments of any debts or contracts of her husband George Stubblefield, except by and the consent of my Exedcutors.

      "____ my will and desire is that my Executors shall ___ is hereby vested in and shall the entire control of said property hereby granted to my Daughter Polly Stubblefield and her children to hold it in trust foe the benefit of said Polly and children to the entire Exclusion of every other person or persons whosoever.

      "Lastly, I hereby appoint constitute and ordain my son Hardy Johnson, my Nephew Larkin Johnson and Elisha Dodson Esq. my Lawfull Executors to carry into effect this my last will and testament according to the true meaning and intent thereof. In witness thereof I hereunto set my hand and ____ my seal this 24th day of October A.D. 1845."
