      Appraisal of his Estate was submitted to the Woodford County August 1795 Court.

      "In the name of God amen. To all christian people to whom these may appertain kno ye this to be the last Will and Testament of the Testor Cyrus McCrackin who for divers good causes hereunto moving as thought fitting to bequeath my Estate real and personal according to this last will and Testament in this way and manner following viz.

      "Item. I give and bequeath to my lovingand beloved wife Elizabeth McCrackin the upper part of my settlement and preemption that I now live on Beginning at the South East corner at a sugar and two Elms thence North 70 West so far as a line North 20 East shale make an equal division of the said settlement and preemption that I now possess containing 1000 and 50 acres in the whole that is to be divided with all the moveable's Estate as hourses cows sheep and swine likewise all my household furnitures and utensils of husbandry and all other ampliments [sp] that may be called my property except what may be hereafter excepted all which real and personal Estate shall be for the use and disposal of my wife for and during her life or while she continues to remain my widow, likewise it is my will that a bond I have upon Andrew McFadfin for one negro girl valued at 75 pounds price that it shall be her property forever.

      "Item. I likewise will that at the expiration of her widowhood or death that my youngest son Cyrus McCrackin shall then become heir to the above mentioned land which shall thenceforth become his own property.

      "Item. I next will to my son Ovid McCrackin the lower half of the said settlement and preemption agreeable to the above division and at my death he shall become heir to the above lower part of the settlement and preemption.

      "Item. I next will unto my son Virgil McCrackin 150 acres of land lying on the North fork of Elkhorn supposed to be about two miles up above the forks also another Tract containing four hundred and seventy eight acres adjoining the aforseaid hundred and fifty acres at my death.

      "Item. I next will unto my eldest daughter Ruth McCrackin five hundred acres of land lying about six miles lying on a road leeding from Dreennon lick to the head of six mle creek at my death.

      "Item. I next will unto my youngest daughter Sally McCrackin Two fifty acres Tracts of land adjoining to each other lying in the first bottom below leestown.

      "Item. I next will unto my adopted son John Shepherd one horse and saddle worth twenty pounds.

      "Memorandum. I would wish that the remainder that I make mention of here in disposing of them in the following manner the land that is in partnership with Humphrey Marshall and myself that is about four hundred and seventy acres lying on the North fork of Elkhorn and that being my part. also five hundred acres that is coming from Charles Bell expected to be in the forks of Elkhorn also the balance of the partnership with Charles Smith. I would wish that out of the above mentioned Lands that two hundred acres should be paid unto Andrew Lear, and three hundred acres to Arganat Reece and the remainder to be sold and to be equally divided amongst my children making no distinction.

      "Signed with my hand and sealed with my seal this 15th day of September 1787 And acknowledged to be my hand and seal before the Witnesses present I also constitute and appoint surveyor John Williams and my brother Ovid McCrackin to be the Executors of this my last Will and Testament. - Cyrus McCrackin - Seal

      The Last will and Testament of Cyrus McCracken deceased was proved in Court by the oath of John Long a subscribing Witness thereto and ordered to be recorded. - Teste Cave Johnson CWC
      And on the motion of John Williams one of the Executors therein named who made oath thereto agreeably to Law and with Richard Young his security enerted into and acknowledged bond in the penalty of two thousand pounds conditioned as the Law directs certificate is granted him for obtaining a probate thereof in due form liberty being reserved for the other Executor to join in the probate when he shall think fit. - Teste T. Turpin Clk

      The Last Will and Testament of Cyrus McCracken deceased was produced in Court and futher proven by the oath of James Hydon one of the subscribing witnesses tgereto and proven to be the hand writing of William Brenham the other subscribing witness by the oath of John Long ___ and the same is ordered to record. - Test John McKinney"

      "Know all men by these presents that I Virgil McCrackin of the county of woodford and state of Kentucky do declare this to be my last will and testament in manner and form following viz:

      "I give and bequeath to my wife Martha three negroes viz: Sophia and her child Charlotte and Maria, also all the household furniture which belonged to her before her marriage, which negroes and household furniture is to be considered her right of Dower to my Estate. I give and bequeath to my Daughter Polly one negro woman named Jenney and her son Charles, a feather bed and furniture, one horse and saddle worth one hundred Dollars. I give and bequeath to my Daughter Martha one negro woman named Vina and her son Peter, one feather bed and furniture and one horse and saddle worth one hundred dollars. The horse and saddle to be paid them by my Exc. at their arrival to the age of 14 years. I give to my son Cyrus one negro woman named Phillis and  her son Sam, bed and furniture. I give to my son George two negro boys Dick and Spencer and the interess of the negroes I have of my Fathers Estate at my mothers death. I give to my son Virgil two negroes Mary and Rachel and one negro man named Sam now in the population of Henry Caldwell, and further I give to my son Cyrus one negro woman named Aggy. I wish all my landed Estate to be sold and equally divided among my children at their marriage or at their arrival to the age of eighteen years of the girls and twenty years of the boys giving two years credit for all my lands except the place I now live upon which I wish to be kept for the purpose of raising my family. It is my wish that my interest in the saw mill and tract of land thereunto belonging should be sold at two annual payments. The plantation whereon Henry Nall now resides not to be sold unless absolutely necessary for the purpose of paying my debts until my youngest son arrives to the age of twenty one years. That the negroes devised to my children to be kept together for the purpose of supporting and schooling them, but is my wish that my Executors should dispose of every foot of land for the purpose of paying my debts before the negroes should be sold. The bond I have upon Brother Cyrus in surveyor Williams hands to be sold at two years credit. The bond Seneca McCrackin has upon Father's estate for three hundred acres of land after giving credit for two fifths, Ovid and my parts to be sold at two years credit. And I do hereby appoint my Brother Ovid, Andrew McKnight and Nathaniel Hart Exc. of this my last will with full power to carry the same unto as full and complete effect as I would do myself given under my hand this [blank] day of [blank] Nov. 1812.

      The foregoing instrument of writing purporting to be the last will and testament of Virgil McCrackin deceased was produced into court and proven by the oaths of Leonard Searey and John Road to be written wholey in his own hand writing & ordered to record whereupon Nathaniel Hart and Andrew McKnight two of the Executors therein named came into court and took the oath prescribed by law and executed bond with Samuel Brooking and Cyrus McCrackin their securities in the penalty of $10,000 conditioned according to law. - Teste John McKinney"
